What is Creditor Harassment?
The Federal Trade Commission prohibits debt collectors from engaging in deceptive or intimidating tactics with the Fair Debt Collection Practices Act. Section 806 of this Act makes it illegal for collectors to engage in any activity that could “harass, oppress, or abuse any person in connection with the collection of a debt.” This type of activity could include:
- Excessive calls or calls outside of reasonable hours
- Real or implied threats
- Shaming
- Vulgar or abusive language
- Using aliases or refusing to reveal the company’s identity
Debt collectors who engage in these or other types of abusive behaviors are committing a crime. You do not have to stand for this type of harassment and you have the right to fight back. Protect your rights and get your life back on track with the help of a knowledgeable bankruptcy attorney.
